Membership

• Membership is created when an individual enrol and paid a fee to The Company for the usage of the gym equipment/facilities. Fees for membership, personal training and other fees are non -refundable and vary from time to time.
• Face recognition is setup upon enrol of membership and entrance to our facilities using face recognition system by member.
• Unless otherwise stated with conditions, members are entitled to access all facilities within operating hours during their Membership period.

Personal Training

• Personal Training services purchase by an individual with The Company has to be complete within the validity period. Unused session will be forfeited without refund.
• Personal Training sessions are to be conducted by an assigned Personal Trainer or member choice of trainer upon signing up of the package and agreed between the Member and The Company.
• Booking of Personal Training sessions can only be done on our website. For any postponement, cancellation you must notify the trainer within 24 hours. For not show up and late for more than 15 minutes will have the Personal Training session forfeited.
• Personal Trainer with reasonable opinion can alter or suspense the training program base on member’s health condition and safety.
• Under unforeseen circumstances, without advance notice or compensation, the company reserves the right to reschedule or assign another trainer to a Member’s Personal Training.

Limitation of Liability

• Member are to declare their physical condition to engage in the usage of the facilities and/or Personal Training session. Members should seek medical advice before using our facilities/Personal Training services.
• The Company shall not be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member’s person or property arising out of, or in connection with the usage of our gym services, facilities or premises by a Member. The member shall not holds The company’s employees and agents from all claims and/or charges which may be brought against them or whatsoever.

Gym Rules & Regulations

The Gym Rules & Regulations are set for all members to abide as follows which may be amended from time to time by the Management:

• No packet drink and food and eating allow in the gym.
  Lifting/liquid/powder chalk is not allowed.
  Appropriate exercise attire and proper shoe required at all times.
• Keep the gym area clean and make it a nice place for everybody to share, Member have to bring towel at all times. Use it where you have contact with the upholstery and wipe your perspiration after use.
• Any forms of vandalism, provocative within member and/or staffs on the premises will be reported to the authorities. Any forms of violence and harassment within the premises is prohibited. You may approach the gym staff for mediation if necessary.
• You are fully responsible for the damage and/or lost to any exercise equipment and/or facilities arising from the course of your usage or misused of the intended purpose in accordance with safety regulations and instruction. Do not slam the equipment.
• Prevent disturbance to others when using the equipment and exercise caution to minimise damage to the equipment.
  Do not perform Exercises that may endanger oneself and/or others are prohibited. Follow accordance with safety regulations.
  Re-rack and return all equipments to their original place. Do not grunt and groan excessively.
• Touting, soliciting and unauthorized training by unauthorised member is not allowed within the premises.
• Commercial purpose Photography/Videography is prohibited unless authorized.
• All Equipment and facilities are share with other members where reasonable and appropriate. Authorised Trainers have priority due to time constraint of the training session.
• Bags and personal item are only allow in lockers and storage cubicles to avoid cluttering up shared spaces within the gym.
• Member who Failure to abide our Gym Rules & Regulations may result from accessing The Company facilities and service and also termination of the Membership.

Membership Termination

The Management may without notice and with immediately effect terminate the Membership of any Member and disallow the Member from accessing our gym facilities/services indefinitely if
i. Member breaches the Membership Terms & Conditions and/or Gym Rules & Regulations;
ii. If the company opinion on Member’s conduct and behaviours is deemed to be unsuitable to be continue as a member
and all privilege shall be forfeited and fee non-refundable. All management decision are final and binding. Upon the termination of the Membership, the Member shall settle any outstanding debts owed to The Company with immediate effect.

Others

a. The company reserves the right to adjust the operating hours of the Gym and notice with reasonable time frames or require by law.
b. The Management reserves the right to dispose any property left within the gym premises after a reasonable timeframe as determined by the Management. No claims shall be entertained for disposed property.
c. The Management have the right to publish photographs or video taken in the gym include of members photo for press and promotional purpose.
d. Selling and/or Possession of illegal substances within our premises found to be breaching the laws will be handed over to the authorities.
e. The Management may at its sole discretion amend, vary, delete or add to these Terms & Conditions with immediate effect and without notice. In the event of any dispute arising out of the interpretation of these rules, the decision of the Management shall be final. The Membership Terms & Conditions shall be governed and constructed in accordance with the laws of Singapore and subjected to the jurisdiction of Singapore.

Personal Data

a. The company collect Member’s personal data in accordance with the Singapore’s Personal Data Protection Act 2012 (“PDPA”) for the following purposes:

• Provision of The Company services, including the administration of Membership subscribe of our service and inquiry;
• Security monitoring;
• Marketing purposes;
• The Company will notify member and ask for consent for other purposes.
• For the purpose of courses enrolment on behalf of third parties academy or courses conducted by Tesseract Fitness Pte Ltd.

b.The company will not disclose Personal date to third parties without prior consent unless:

• The authority requested for further investigation or proceeding ;
• To respond due to an emergency that threatens the life, health or safety of the Member or other individual(s);
• Disclosure of personal data permitted without consent by the PDPA or by law.

c. The Company will put 100% effort to ensure that Members’ personal data are protected and secured against unauthorized access and usage.
